NOTICE: Through Antivassistance services, you are accepting these terms and conditions, and those in the future, expressing that you have read and understand them. if you do not accept the terms ("terms"), do not use the antivassistance software or this website.
This User Agreement is between you (including any of your agents, contractors, and employees) and My Computer Works – Antivassistance, a state of Arizona corporation. It will be effective from the date you electronically accept. You further agree to be bound by the terms of this agreement for transactions entered into on your behalf by anyone acting as your agent and transactions entered into by anyone who uses your account, whether or not you otherwise authorized the transactions. This is the agreement that applies to your use of the Antivassistance website and software.
The Software: Antivassistance Software – You can manage the performance, stability, and security of your Windows 10 or Windows 11 computer. It gives tailored suggestions to assist users in keeping their systems in the best shape. The software is a self-help style. Licensed users can also use the in-app chat to chat with a tech and be provided additional self-help if required.
All Users shall observe any relevant legislation and regulations. If My Computer Works (MCW), in its sole discretion, believes that any crime has been, is being, or may be committed, MCW may report such information to appropriate authorities. MCW may assist law enforcement in the prosecution of any user violating this TOS or law, and may remove the software licensed to it at any time.
Availability of Service: Self-help support through the chat utility is available 7 days a week from 8:00 am - 8:00 pm local time.
Fees: For use of the Antivassistance Licensed Software, MCW shall charge a one-time installation charge of $9.95 and a monthly charge of $9.95 for periodic monitoring and support services or in connection with granting a Lease in respect of certain of the Antivassistance licensed software during the Term of this Agreement. Accepting this Agreement indicates that you are willing to pay the service fees provided herein. Antivassistance may change the pricing at any time. Such fees will be available to you on the Antivassistance website and will be updated regularly, and can be reviewed by you from time to time.
Payment Method: You agree to keep a valid credit or debit card on file with My Computer Works (MCW) for payment of service. If you opt for the monthly plan, you will also be charged in advance at the same time each month on the date that corresponds with your original purchase date (except for the 29th, 30th, or 31st, in which case you will be charged on the 28th). During the term of this Agreement, you must maintain a valid credit or debit card on file with Antivassistance.
Monthly Plans: Monthly plans are paid on a month-to-month basis. You can also cancel your software license anytime. Billing automatically recurs monthly until you cancel your license in writing.
Cancellation Policy: The Criminal Base is offered on a month-to-month, no-contract basis with no cancellation fee. If MCW is for any reason unable to charge your credit card with the full amount of the service charge for access to MCW, Antivassistance shall have the right to pursue all available remedies to enforce the terms of this Agreement, including taking whatever action necessary to collect the service charge. You will also be responsible for all reasonable costs we incur in collecting the amounts owed to us and all costs we incur to enforce this Agreement, including reasonable attorneys' and collection agencies' fees.
Account Reinstatement: membership that is canceled or terminated may be reinstated (in its then-current form) within 90 days of such cancellation or termination without incurring an additional activation fee. thereafter, MCW may, at its discretion, reinstate with payment of a reinstatement fee.
Your Cooperation: You agree that you are responsible for ensuring that you have a high-speed, broadband internet connection with a minimum continuous speed of 256 kilobits per second (256k) for both upload and download. this link should not be limited in bandwidth, or antivassistance software will be prevented from functioning. satellite internet, mobile “air cards,” and cell phone tethering are not considered the primary internet connection for membership use.
Limitation of Liability: In no event shall my computer works (MCW) or its suppliers be liable for any indirect, incidental, consequential, or special, exemplary, or punitive damages arising out of or in connection with the use of the software or service. this includes, but is not limited to, claims under standardized contracts and claims based on warranty, contract, tort, and negligence (including strict liability).
in no event shall the aggregate liability of MCW or its suppliers exceed the amount that you paid to MCW in the 12 months preceding the date of your claim. if the software is provided at no cost, then MCW and its suppliers shall have no liability to you anyway.
these limitations include damages for loss of profits, loss of information, or other monetary loss, use, misuse, inability to use, or reliance by any user on the software, or any interruption, suspension, or termination of service, no matter whether it is claimed such damages arise from a third party. this restriction will apply notwithstanding the failure of the essential purpose of any remedy and to the fullest extent permitted by law.
Note: The failure of some jurisdictions to permit the limitation of liability for incidental or consequential damages could have some application to this section. in those instances, the restrictions described in these terms may not apply to you.
Force Majeure: If MCW or its third party service provider is unable to provide the services as a result of factors beyond our control (such as, but not limited to severe weather, natural disasters, road and traffic conditions, labor strikes, and any other factors that we may determine necessary) - we may delay the services and/or reschedule the service without liability.
Use of Software: If you receive software from this website or if MCW gives you software other than software as a service (located on the server), you will be under a license to use all of the software, images, and data that are part of the software, whether the software is on your computer or maintained on the server by MCW. All title and intellectual property rights in and to the software and documentation are owned by MCW or the vendor/licensor. No ownership rights are granted to you.
You shall not develop, create, copy, share, sell, market, distribute, or otherwise make available the software or any product that is based upon, derived from, or distributed with any of the software. You are not authorized to download or install the software unless you have read and accepted these terms.
You agree that, at your direction (e.g., clicking on an onscreen acknowledgement), MCW may remotely inspect your computer, including software installed on it, as well as databases and system elements. During this session, MCW may apply updates or fixes, which may get automatically downloaded on your machine. If personal and system-specific information is obtained during this access, MCW will use its best efforts to hold such information in confidence, unless disclosure is required by law.
Vendor Software and Third-Party Links from Downloads: MCW could use management software to track if your computer is "healthy" and to download and run components to detect or fix system issues. However, MCW does not promise that all such issues will be found, diagnosed, or remediated, nor does it guarantee protection against viruses, spyware, worms, or other threats.
MCW can install code on your computer that operates both actively and passively with other applications in order to monitor the performance of your computer as well as to identify problems. User downloads the Software may also include links to third-party websites or third-party software. I am putting these here for linkage and easy download. You are responsible for taking all necessary precautions to ensure that any content, software, or other materials or links that you may access, use, open, or download from this website, website content, and third-party sites are free of viruses, worms, Trojan horses, and other items of a destructive nature.
You acknowledge and agree that MCW is not responsible or liable—directly or indirectly—for any damage or loss caused, or alleged to be caused, by or in connection with your use of, or reliance on, third-party software, content, products, or services—except as described in this policy—or other resources available through this site or any linked resource.
Use of Site: MCW grants you a non-exclusive, non-transferable, and limited license to access and download software and materials from this Site and from any website to which this Site is linked or affiliated (the Site) on a single computer solely for your personal, non-commercial use or for internal use within your company. All of the content you can view through the Site, including, for example, software (whether downloaded by you or by MCW), text, photographs, video, text, graphics, music and sound, graphics and other material (collectively: “Content”) is protected by copyright (except as explicitly stated otherwise on or in the Site) as a collective work and/or compilation, under copyright laws, and international conventions. Sharing with other computers or outside of the people involved is not allowed.
You must keep intact all copyright and other proprietary notices on downloaded materials. You shall not modify, translate, decompile, disassemble (except to the extent applicable laws specifically prohibit such restriction), attempt to derive the source code of, or decrypt the Content, nor create any derivative work based on the Content. The use of any Content on any other website, or in a networked computer environment, is strictly prohibited, and such use may violate copyright and other intellectual property laws. The use of the Content without the consent of the owner is strictly prohibited.
Trademarks and Service Marks: This Site also contains proprietary logos, service marks, and trademarks, and we use the proprietary name of a slogan. They are not licensed or otherwise authorized for use by visitors to the Site. MCW has pending and/or issued patent applications with the U.S. Patent & Trademark Office. Other names and brands may be claimed as the property of others.
User Submissions: Except for personal identity information or computer-related information collected for internal use and to improve your experience in the Site and for our customer service activity, any material, information, or other communication you transmit or post to the Site will be considered non-confidential and non-proprietary (“Communications”). Although MCW has established commercially reasonable security measures in place to protect personal information, you provide such information at your own risk.
You agree that MCW may use aggregated and anonymized data for analytics, operations, or marketing. All oral and written dialogue between you and MCW may be (but is not necessarily) recorded and/or used for training purposes or promotional materials by MCW. You shall not misrepresent your or any participant's identity or act as another person or entity in registering for use of the Services, or for use of, and in using, the Site or Services. If you submit suggestions or improvements, you grant MCW an irrevocable, nonexclusive, royalty-free license to use such ideas in perpetuity without compensation.

Upon completion of your software licensing, you will receive a confirmation email or SMS from MCW.
You are not required to consent as a condition of purchasing any property, goods, or services. detective applicable texts and calls by using detective, you may receive SMS and mms messages from us, including messages regarding accounts and services if applicable. Message frequency may vary. Transport of messages is not guaranteed, and messages may not be delivered at all or promptly.
Termination: This Agreement shall be effective as of the date you accept these Terms and purchase the service and will remain effective until you are no longer a customer of MCW. MCW, in its sole discretion, may terminate or limit your access to the site, the Antivassistance software, and any related services at any time, without notice. This includes — but is not directly restricted to — these terms in letter or spirit, any breach of this agreement, and nonpayment of fees.
You agree that MCW will not be responsible to you or any third party for any such suspension or termination of your license or access. Upon termination, you will destroy the software and all copies thereof.
Disclaimer: 'Acceptance of License Terms.' The Antivassistance Software being downloaded by or on the advice of MCW, as well as all materials or services supplied by MCW, are licensed "as is" without warranty of any kind, whether express or implied. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement, and warranties that access to or use of the service will be uninterrupted or error-free.
MCW shall not be responsible or liable for the availability, accuracy, reliability, security, performance, or pricing of Antivassistance software, vendor software, this site, or any websites linked to or from this site. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for some types of damages.
You download from, or otherwise obtain content or software through, MCW or the MCW Services at your discretion and risk. This is the only responsibility of this code you are running, and it is at your own risk if your system gets damaged by anything. The product, service, or program discussed on this Site may not be available in all countries. You are responsible for all local charges, which include local taxes.
Limitation of Liability: In no event shall MCW be liable for any damages whatsoever, including, without limitation, the following:

Applicable Laws: MCW controls and operates this site from the United States of America. MCW makes no representation that the materials contained on the site are appropriate or authorized for use in all countries, states, provinces, counties, or any other jurisdictions. Accessing the site from any such area of the site where the content is illegal is expressly prohibited.
You may not open, access, or otherwise use the Site from outside the United States or Canada, and if you choose to do so, you are responsible for complying with local laws thereof. You shall not use or export the downloaded software or content in violation of U.S. export laws and regulations.
You also agree to comply with all applicable laws and regulations — U.S. and International, as well as any other restrictions on your use of the Services, including export or re-export of technical data from the U.S. and your country of residence. You further agree to comply with all local rules regarding online conduct and acceptable content, including all laws, rules, codes, and regulations of the country in which you reside and the country from which you access this site.
Governing Law and Arbitration: These Terms are governed and construed by the laws of the State of Arizona, without regard to its conflict of law provisions.
The parties also hereby submit and consent to the jurisdiction and venue of, and waive any objection to any such forum as inconvenient, the superior court of the State of Arizona, in and for the County of Maricopa, about any such legal proceedings between them.
Any dispute not yet settled between the parties shall be settled at last by arbitration submitted to arbitration, which arbitration shall be held by the then-effective International Arbitration Rules of the American Arbitration Association (AAA). The arbitration will be held in Phoenix, Arizona.

Entire Agreement: These Terms are the entire and exclusive understanding and agreement between you and MCW regarding this subject matter, and they supersede all prior or contemporaneous oral or written communications, proposals (whether written or oral), understandings, representations, and agreements regarding such subject matter. It is also agreed that any amendment or modification to these Terms shall be in writing and signed by both parties. MCW’s failure to act concerning any provision of these Terms will not be considered a waiver of such provision or any other provision of these Terms.
Notices: MCW can give you notice of changes by email, regular mail, or by posting the changes on the Site. Notices are effective when made by us upon sending notice to you at either (A) the email address you provided to us, or (B) through the Services, or when posted by us.
Revisions: MCW also reserves the right to change, in its sole discretion, any of the information or material contained in the Site at any time without notice. Please periodically revisit these Terms to review them. You are bound by these Terms. Some terms within these Terms may be superseded by directly designated legal notices or terms located on particular pages at this Site.

Acceptance of Terms - Your access to and use of the site, as well as software and other content (defined below) downloaded from MCW or its vendors, is subject to and conditioned upon your acceptance of and compliance with these terms. You represent that you are authorized to agree to these Terms on your behalf, or on behalf of any entity for which you are employed.
